Mantas Rubštavičius’ motion for a temporary restraining order will not be decided prior to Auburn’s exhibition against Alabama Thursday.

Rubštavičius’ attorney filed a motion for extension of time, which Lee County Circuit Judge Jeffrey Tickal granted Tuesday. The supplement brief  must be filed by Oct. 23, and the NCAA will have until Oct. 27 to respond.

Initially, Tickal indicated a ruling on the TRO could come prior to the Thursday exhibition, but that decision has now been delayed.

Rubštavičius and the NCAA met in court last Friday, leaving his eligibility unresolved.

There will be a preliminary injunction hearing on Nov. 4 — the same day of Auburn’s season opener against Southeastern Louisiana.
